The proposals are part of the Tourism Laws (Amendment) Bill, 2025, now before the National Assembly’s Departmental Committee on Sports and Tourism.

The reforms look administrative. They are really about who gets to regulate one of Kenya’s most important foreign-exchange earners—and how much bureaucracy is required to do it.

The Bill proposes the consolidation of several institutions, including the Kenya Tourism Board, Tourism Research Institute and Tourism Finance Corporation, among others. A new Tourism Regulatory Authority would take on regulatory functions currently spread across different bodies.

There is an obvious attraction.

Kenya’s tourism industry has accumulated a sizeable collection of boards, authorities and agencies, each with its own mandate, management structure and budget. The argument for consolidation is therefore familiar: reduce duplication, clarify responsibilities and make the state less cumbersome.

The less obvious question is whether merging institutions actually makes government simpler.

It sometimes merely produces a larger institution.

The committee is now inviting views from the public and industry stakeholders before the Bill proceeds. The proposed reforms would amend several laws governing tourism and change the institutional framework under which the sector operates.

That makes consultation important.

Tourism is not simply a government department. Hotels, airlines, tour operators, conservancies, restaurants, conference organisers and small informal enterprises all depend on the rules that govern the sector. A regulatory change that looks tidy in Nairobi can have rather different consequences in Diani, Maasai Mara or Watamu.

The Bill’s proposed Tourism Regulatory Authority is intended to centralise regulatory functions.

Centralisation has its uses.

So does specialisation.

The danger is that the former can swallow the latter. A tourism regulator that becomes responsible for too many activities may be more coherent on paper and slower in practice. Businesses do not care much whether a licensing delay results from five agencies or one. They care that the licence has not arrived.

Kenya’s tourism industry can ill afford administrative sclerosis.

Tourism earnings have recovered strongly since the pandemic, helped by the return of international travel and growing domestic demand. The sector is also becoming more diversified, with interest in conference tourism, cruise tourism, sports tourism, wellness and cultural experiences supplementing the traditional safari-and-beach model.

That diversification makes regulation more complicated.

A wildlife conservancy does not face quite the same problems as a conference venue. A coastal hotel does not operate like a cultural attraction. Treating all of them through one regulatory template may produce consistency; it may also produce unnecessary paperwork.

The committee’s public participation process is therefore more than constitutional ritual. Industry operators have an opportunity to say which functions genuinely overlap and which merely look similar from the outside.

That distinction matters because mergers have a seductive logic.

Two agencies become one. Two chief executives become one. Two boards become one. The organogram becomes smaller.

The budget does not necessarily follow.

Institutions have a remarkable capacity to survive their own abolition. Functions move. Departments are renamed. Staff are redeployed. New directorates appear. The machinery changes its label and carries on—sometimes with another layer added.

This is why the proposed reforms should be judged by what tourists and businesses experience, rather than by how elegant the legislation looks.

If a hotel operator can obtain licences more quickly, a tour company can deal with one regulator instead of several, and investors can understand the rules without consulting a small army of lawyers, the merger will have earned its keep.

If not, Kenya will merely have consolidated its paperwork.

There is another reason to tread carefully. Tourism is unusually exposed to international competition. Visitors can choose Tanzania, Rwanda, South Africa, Mauritius or Botswana. They do not generally care which Kenyan agency has responsibility for licensing a tourism facility. They care about price, safety, service, access and the quality of the experience.

Regulation should therefore be an enabler, not an industry in itself.

The proposed reforms come at an interesting moment. Kenya is trying to extract more value from tourism while broadening the sector beyond the established safari circuit. That requires investment, product development and private-sector experimentation. Excessive regulation can impede all three.

But fragmented regulation has costs too. Investors dislike uncertainty. Consumers dislike weak standards. And an industry with several regulators can sometimes exploit the gaps between them (businesses are rarely opposed to ambiguity when ambiguity works in their favour).

The proposed Tourism Regulatory Authority could close some of those gaps.

It could also become another powerful bureaucracy.

Which one it becomes will depend less on the title Parliament gives it than on the functions, funding and accountability mechanisms written into the law.

That is why the public consultation matters.

Parliament is asking Kenyans to comment before it reshapes the machinery of tourism. The industry should take the invitation seriously. Once the agencies have been merged, the boards dissolved and the new authority established, reversing the architecture will be considerably harder.

Kenya does not necessarily need fewer tourism institutions.

It needs fewer reasons for businesses to wonder which institution they are supposed to be dealing with.

The country’s tourism bureaucracy may soon have fewer chairs around the table.
